Mediation is a method of alternative dispute resolution whereby a neutral third party facilitates a mutually acceptable resolution between the parties. The mediator does not make any decisions, but rather serves as a facilitator, allowing the parties to arrive at their own agreement in a non-adversarial environment. The parties decide the terms and fairness of their own agreement with or without independent advice from their attorneys, with the cost of the mediator shared in whatever way the parties themselves believe to be fair.
