Resolve Your Divorce through Mediation or Alternative Dispute Resolution (ADR)

Mediation is growing in popularity for resolving all sorts of business and personal disputes in an out-of-court setting.  When a divorcing couple realizes just how expensive a court battle will be, many opt to work out their differences at the mediation table rather than have a judge impose a solution on them.  We are pleased to have Partner Drew A. Molotsky, Esq. to assist our clients who chose to use mediation to resolve their custody, parenting time, or divorce matter.  Drew A. Molotsky, Esq. is a N.J. Court Rule 1:40 qualified mediator and a Certified Matrimonial Law attorney with 15 years experience as a Matrimonial Early Settlement Panelist for the Family Court, a former member of the District III-B Attorney Ethics Committee, and 24 years experience as a courtroom litigator.

Mediation is a method of alternative dispute resolution whereby a neutral third party facilitates a mutually acceptable resolution between the parties.  The mediator does not make any decisions, but rather serves as a facilitator, allowing the parties to arrive at their own agreement in a non-adversarial environment.  The parties decide the terms and fairness of their own agreement with or without independent advice from their attorneys, with the cost of the mediator shared in whatever way the parties themselves believe to be fair.

Rather than paying divorce lawyers to stand around at the courthouse waiting for your hearing to begin, mediation offers couples the flexibility to schedule meetings at convenient times and work around your schedules.  Instead of a public court battle that leaves only bitterness and resentment in its wake, mediation moves the dispute to a far less contentious atmosphere.  This preserves a healthy relationship between ex-spouses beyond the divorce so that they can move on with their lives and co-parent their children, sharing in their special milestones and life events.

Learn About the Divorce Mediation and Arbitration Process

Many divorcing couples are looking towards alternate dispute resolution tactics as a means to settle their cases and move on with their lives. Court backlogs and the high cost of contentious divorces have been driving forces in moving couples from traditional divorce tracks to either arbitration or mediation.  Often these two processes are mistaken for each other, but the two are indeed very different. Mediation and arbitration do share some commonalities. Both are confidential, cost-effective, and expeditious alternatives to mainstream divorce litigation.

In arbitration, the process requires that each spouse voluntarily submit their divorce matter to a neutral third party, known as an arbitrator, who ultimately renders a final ruling on the settlement.  The arbitrator is mutually selected by the litigants and may be a matrimonial attorney or a former judge. Key in the selection of an arbitrator is that they are experienced and familiar with the nuances of matrimonial law. There are some instances where the court will appoint an arbitrator when the spouses cannot agree.  The role of the arbitrator is to act much like a judge would during a trial.  The proceedings are usually much less formal than a trial, but the arbitrator does render a decision much in the same fashion as a judge.  The cost of arbitration is usually divided between the parties.

Private mediation is also a voluntary and confidential process. The goal of private mediation is to maintain a non-adversarial atmosphere that provides the parties with the opportunity to create a settlement structure personalized to their unique situation. Generally, both parties share in the cost of the mediator, who again may be a matrimonial attorney or a retired judge.  The role of a divorce mediator in New Jersey is to serve as a neutral third party during negotiations and help facilitate a mutually acceptable resolution.
